1. Scope and seller identification

1.1 These General Terms and Conditions of Sale (hereinafter „T&Cs") apply to all contracts for the purchase of goods concluded through the online shop viworo.com between the seller and the customer. Different conditions of the customer are accepted only if expressly agreed in writing.

1.3 Definitions:

  • A consumer is any natural person who concludes a transaction for purposes that are not predominantly related to their commercial, trade, craft or professional activity (Art. 3, para. 1, lett. a, D.lgs. 206/2005 – Italian Consumer Code).
  • An entrepreneur is any natural or legal person who acts in the course of their commercial or professional activity.

2. Conclusion of the contract

2.1 Product descriptions in the online shop do not constitute binding offers, but rather an invitation to the customer to submit a contractual proposal.

2.2 The customer submits their contractual proposal by selecting the products, entering their data in the online order form and clicking the order confirmation button („Buy" or equivalent).

2.3 Acceptance of the offer by the seller takes place by sending an order confirmation via e-mail or by delivering the goods, within five (5) business days from receipt of the offer. After this period without acceptance, the offer is considered lapsed.

2.4 The contract text is stored by the seller and sent to the customer via e-mail together with the order confirmation, along with these T&Cs in reproducible form.

2.5 Languages available for concluding the contract are Italian (main language), German and English.

3. Right of withdrawal

3.1 The consumer is granted the right of withdrawal pursuant to Articles 52 et seq. of D.lgs. 21/2014 (Italian implementation of EU Directive 2011/83/EU).

3.2 Extended period: The seller voluntarily grants an extended withdrawal period of 30 days from delivery of the goods (beyond the statutory minimum of 14 days). For selected products the period extends to 90 days; the extension is indicated on the respective product page.

3.3 How to exercise the right: The consumer can exercise the right of withdrawal by:

  • Completing the electronic withdrawal form provided by the seller (recommended method, compliant with EU Directive 2023/2673 in force from 19 June 2026);
  • or by sending an explicit declaration via e-mail to info@viworo.com, indicating order number, items to be returned and contact details.

3.4 Effects of withdrawal: In case of valid withdrawal, the seller will refund all payments received from the consumer, including the original shipping costs (with the exception of additional costs for shipping methods other than the cheapest standard shipping), within 14 days from receipt of the goods or from proof of return, using the same payment method as the original order.

3.5 Return shipping costs: The costs of returning the goods are borne by the consumer, except in case of defective, damaged or incorrectly delivered products.

3.6 Exclusions: The right of withdrawal does not apply in the cases provided for by Art. 59 D.lgs. 206/2005, in particular for sealed products that are unsuitable for return for reasons of health protection or hygiene once they have been opened (e.g. essential oils, mother tinctures, plant extracts, natural cosmetics), as well as for personalised or made-to-order products and for gift cards.

3.7 The right of withdrawal does not apply to consumers whose domicile and delivery address at the time of contract conclusion are outside the European Union.

4. Prices and payment terms

4.1 Prices: All prices shown in the online shop are total prices in Euro. The seller operates under the flat-rate scheme („regime forfettario") pursuant to Italian law; VAT is therefore not shown on invoices pursuant to Art. 1, para. 54-89, L. 190/2014. Any shipping costs are shown separately before order confirmation.

4.2 Additional costs: For deliveries outside the European Union, additional costs may arise (customs duties, import taxes, bank fees) which are not attributable to the seller and are borne by the customer.

4.3 Accepted payment methods:

  • PayPal – via the PayPal service (PayPal terms of use apply)
  • Credit card (Visa, Mastercard, American Express)
  • Shop Pay – Shopify's integrated payment platform
  • Apple Pay
  • Google Pay
  • Advance bank transfer – bank details are provided after order confirmation; goods are shipped after payment is received (within 7 days of the order)

All payments are encrypted and securely processed via Shopify.

4.4 Due date: Payment of the purchase price is due immediately upon contract conclusion, unless a different payment term has been agreed.

4.5 Default: In case of default by the customer, the seller is entitled to default interest at the statutory rate pursuant to D.lgs. 231/2002.

5. Delivery and shipping conditions

5.1 Delivery countries: The seller currently ships to the following countries: Italy, Germany, Austria and other member states of the European Union. Shipments to Switzerland are currently not made.

5.2 Delivery times:

  • Italy: 2–4 working days (express shipping)
  • Germany: 7–10 working days
  • Austria: approximately 7 working days
  • Other EU countries: 7–14 working days

The times indicated start from the day following payment confirmation.

5.3 Shipping costs: Applicable shipping costs are transparently shown at checkout before order confirmation. For orders above the thresholds indicated on the shipping page (from €25 within Italy, from €50 for EU shipping), shipping is free.

5.4 Failed delivery: If delivery fails for reasons attributable to the customer (e.g. wrong address, repeated absence), the customer bears the reasonable costs incurred by the seller for re-delivery, unless the customer effectively exercises their right of withdrawal.

5.5 Transfer of risk: The risk of loss or damage to the goods passes to the consumer at the time of physical delivery of the goods by the carrier (Art. 63 D.lgs. 206/2005).

6. Retention of title

In case of incomplete advance payment, the seller retains ownership of the delivered goods until the purchase price has been paid in full.

7. Statutory warranty of conformity

7.1 Products purchased by the consumer are covered by the statutory warranty of conformity for a duration of 24 months from delivery, pursuant to Articles 128 et seq. of D.lgs. 206/2005 (Italian Consumer Code).

7.2 In case of a defect of conformity, the consumer has the right to restoration of conformity of the goods through repair or replacement, free of charge, or – in cases provided for by law – to a price reduction or to termination of the contract.

7.3 The consumer is requested to inspect the goods upon delivery and to report any transport damage to the carrier and to the seller via e-mail at info@viworo.com, preferably with photographic documentation. Failure to report does not prejudice the consumer's legal rights.

8. Liability

8.1 The seller is liable within the limits provided by Italian law for damages caused to the consumer in connection with the performance of the contract.

8.2 The products offered are natural products, food or cosmetics. The consumer is requested to carefully read the instructions for use and warnings on the packaging and, in case of doubt, to consult their doctor, pharmacist or trusted specialist before use, especially in case of pregnancy, breastfeeding, existing health conditions or ongoing medication.

9. Processing of personal data

The customer's personal data is processed in compliance with the Regulation (EU) 2016/679 (GDPR) and the Italian Privacy Code (D.lgs. 196/2003 as amended). For detailed information on the purposes of processing, data collected, rights of the data subject and storage periods, please refer to the Privacy Policy available on the website.

10. Alternative dispute resolution

10.1 The European Commission provides an Online Dispute Resolution (ODR) platform, accessible at the following address: https://ec.europa.eu/consumers/odr.

10.2 The seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body.

11. Applicable law and jurisdiction

11.1 These T&Cs and the contracts concluded on their basis are governed by Italian law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

11.2 For disputes with consumers residing in the European Union, the mandatory consumer protection provisions of the law of the Member State in which the consumer has their habitual residence remain applicable.

11.3 Jurisdiction: For disputes with consumers, the exclusive jurisdiction lies with the court of the place of residence or domicile of the consumer (Art. 33, para. 2, lett. u, D.lgs. 206/2005). For disputes between entrepreneurs, the court of Bolzano has jurisdiction.

12. Final provisions

12.1 Should any provision of these T&Cs be invalid or ineffective, the validity of the remaining provisions remains unaffected.

12.2 The seller reserves the right to modify these T&Cs at any time. Changes take effect upon publication on the website; for contracts already concluded, the version of the T&Cs in force at the time of contract conclusion applies.
